1. Service Description

GlobalComply provides automated compliance screening and Enhanced Due Diligence (EDD) report generation services. Our platform analyzes transaction data, counterparty information, and goods classifications to generate compliance documentation.

2. Important Disclaimer

GlobalComply is a software provider, not a bank or legal firm. We do not guarantee that any specific financial institution will process a transaction. Our reports are based on data available at the time of generation and should not be considered legal advice.

3. Customer Warranties

By using our Service, you warrant that:

  • You are not on any SDN (Specially Designated Nationals) or Sanctions list
  • You will not use our service for any illegal purposes
  • All information provided to generate reports is accurate and complete
  • You have the legal authority to conduct the transactions being analyzed

Use of our service for illegal purposes, including sanctions evasion, results in immediate termination without refund.

4. Limitation of Liability

In no event shall GlobalComply's liability exceed the amount paid by the Customer for the specific Service that gave rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

5. Payment Terms

All fees are quoted in Euros (€) and are due upon receipt of invoice. For monthly retainer plans, payment is due at the beginning of each billing period. We reserve the right to suspend services for overdue accounts.

6. Refund Policy

For single report purchases: We offer a money-back guarantee if a bank rejects our report due to formatting issues. This does not apply if the transaction is rejected for substantive compliance reasons unrelated to our documentation format.

7. Intellectual Property

All reports generated by GlobalComply are provided for the Customer's use only. Our methodology, algorithms, and proprietary data sources remain our exclusive intellectual property.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
